- Note: We do not store your full credit card information. Stripe handles all payment data securely in compliance with PCI-DSS standards.

Use of Your Personal Data

Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
Specific Retention Periods:
Account Information: Retained for the duration of your account plus 30 days after account closure, unless legally required to retain longer.
AI-Generated Content:
- Free Plan: Retained indefinitely and may be used for promotional purposes. You may request deletion through your account settings or by contacting support.
- Paid Plan: Retained for the duration of your subscription plus 90 days after cancellation to allow for potential reactivation. After this period, content may be permanently deleted unless you request an extension.
Payment Information: Transaction records retained for 7 years to comply with tax and accounting regulations. Full credit card details are never stored (handled by Stripe).
Usage Data: Generally retained for 2 years for internal analysis and service improvement, except when used to strengthen security or when legally obligated to retain longer.
Email Communications: Marketing email preferences and history retained until you unsubscribe or close your account.
AI Prompts and Generation History: Retained for the duration of your account to provide service continuity and support. Anonymized prompts may be retained indefinitely for service improvement.
Data Deletion Requests:
You may request deletion of your personal data at any time by:
- Visiting your account settings and selecting "Delete Account"
- Contacting us at support@creatok.ai with "Data Deletion Request" in the subject line
Please note:
- Account deletion is irreversible and will result in permanent loss of all your data
- Some data may be retained in backup systems for up to 90 days
- We may retain certain information when we have a legal obligation or lawful basis to do so (e.g., for fraud prevention, legal compliance)
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. AI-Generated Content and Intellectual Property
Content Ownership
The ownership of AI-generated content (including videos, images, and other media) depends on your subscription plan:
Free Plan Users
- Ownership: All content generated using the free plan belongs to Creatok and may be used by us for promotional purposes, service improvement, and public display.
- License: You are granted a non-exclusive, non-transferable license to use the generated content for personal, non-commercial purposes.
- Public Sharing: Free plan content may be made publicly available in our gallery or shared for promotional purposes.
Paid Plan Users (Pro/Premium)
- Ownership: You retain full ownership and intellectual property rights to all content you generate.
- Privacy: Your content will not be used for promotional purposes without your explicit consent.
- Commercial Use: You may use your generated content for commercial purposes without restriction.
- License Grant: You grant Creatok a limited license solely to provide the Service to you (e.g., storing and displaying your content in your account).
Content Usage and Processing
- Prompt Storage: We store your text prompts to provide the Service, maintain your generation history, and improve our AI models.
- AI Training: We do not use your personal prompts or generated content to train third-party AI models without your consent.
- Content Moderation: We reserve the right to review and remove content that violates our Terms of Service or applicable laws.
- Data Retention: Generated content is retained according to your account status and our retention policies (see Data Retention section).
User Responsibilities
- You must have the necessary rights to any input content (text, images) you provide.
- You are responsible for ensuring your content complies with applicable laws and regulations.
- You must not generate content that infringes on third-party intellectual property rights or violates our Terms of Service.
Children's Privacy
Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.
If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.
